How Roseth Mortgage, LLC and HomeSync collect, use, and protect your information.
This Privacy Policy and Terms of Use ("Policy") governs the manner in which Roseth Mortgage, LLC ("we," "us," "our," or "Roseth Mortgage") collects, uses, maintains, and discloses information collected from users of the Roseth Mortgage website at rosethmortgage.com and the HomeSync platform at homesync.network (together, the "Sites" or "Services").
HomeSync is operated by Roseth Mortgage, LLC. When you use HomeSync, you are interacting with a Roseth Mortgage service. This Policy applies to all products, features, and services offered across both Sites, including mortgage lending services, real estate agent partner programs, AI-powered buyer qualification tools, and property search services.
By using our Sites or Services, you acknowledge that you have read, understood, and agree to be bound by this Policy.
We collect information in several categories, depending on how you interact with our Services.
We may collect personal identification information from users when they visit our Sites, register an account, subscribe to communications, submit a form, apply for a mortgage, claim a city as a real estate agent partner, respond to a survey, or engage with other features and resources. This may include name, email address, phone number, mailing address, real estate license number, NMLS identifier, and similar identifiers.
Users may visit our Sites anonymously. We only collect personal identification information that users voluntarily submit. Users can decline to provide personal information, but some features may not be available without it.
When a user applies for mortgage services through Roseth Mortgage, we collect financial and credit-related information necessary to evaluate the loan application, including income, employment, assets, liabilities, Social Security number, and credit history. This information is collected under the Gramm-Leach-Bliley Act (GLBA) and is treated as Non-Public Personal Information ("NPI"). NPI is collected, used, and protected in accordance with applicable federal and state financial privacy laws.
When a real estate agent signs up for our HomeSync Partner Program or claims a city, we collect information necessary to verify their licensure and support their use of the platform, including real estate license number, brokerage affiliation, MLS identifiers, service area, professional profile content (bio, photo, branding), and listing data retrieved from their MLS via authorized MLS Grid or comparable feeds.
We collect information about how users interact with our Sites, including pages viewed, listings saved, AI chat interactions, property searches conducted, and pre-qualification activities. This data helps us improve our Services and match buyers with relevant agents and listings.
We collect non-personal identification information whenever users interact with our Sites. This may include browser type, device type, operating system, internet service provider, referring URLs, and similar technical information.
Our Sites use cookies and similar tracking technologies to enhance user experience, analyze Site traffic, and support core functionality. Users may set their browsers to refuse cookies or to alert them when cookies are being sent. If cookies are refused, some parts of the Sites may not function properly.
We also use third-party analytics services including Google Analytics and Meta (Facebook) Pixel to understand how our Sites are used. These services may collect information about your visits to our Sites and other websites.

When a consumer interacts with a featured agent's profile or listing, contact and intent information may be shared with that agent to facilitate the consumer's inquiry. Consumers are notified before this sharing occurs and may decline.
Mortgage applicants' information may be shared with Roseth Mortgage's authorized affiliates, investors, and settlement service providers as necessary to process and close a loan. This is disclosed separately in our GLBA Notice provided at the time of mortgage application.
We may disclose information when required by law, subpoena, court order, or other legal process, or when necessary to protect the rights, property, or safety of Roseth Mortgage, our users, or others.
If Roseth Mortgage is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify users and provide choices where legally required.
We adopt appropriate data collection, storage, and processing practices and security measures to protect against unauthorized access, alteration, disclosure, or destruction of personal information, usernames, passwords, transaction information, and other data stored on our Sites. By submitting a contact request or inquiring about loan products or HomeSync services through our Sites, you consent to be contacted by Roseth Mortgage, its authorized partners, and affiliates by telephone (including on recorded lines), automated calling, pre-recorded calling, text message, email, fax, or other means, even if you have opted in to the National Do Not Call List, any state equivalent Do Not Call List, or any internal Do Not Call List.
No mobile phone information collected through our Sites will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with service providers in support of our own operations (such as customer service providers) is permitted. SMS opt-in data and consent will not be shared with any third parties.
You may opt out of marketing communications at any time by following the unsubscribe instructions in any email we send, replying STOP to any text message, or contacting us directly at jeremyroseth@rosethmortgage.com. Opting out of marketing communications will not affect transactional communications related to your account or active applications.

Protecting the privacy of children is important to us. We do not knowingly collect or maintain personal information from children under 13. No part of our Sites is structured to attract or be accessible to children under 13. If we become aware that we have collected personal information from a child under 13, we will delete that information promptly.
Our Services are operated in and directed to users in the United States. If you access our Sites from outside the United States, your information may be transferred to, stored, and processed in the United States, where our servers and central database are located. By using our Sites, you consent to such transfer.
We retain personal information for as long as necessary to provide our Services, comply with legal obligations (including mortgage loan record retention requirements under federal law, which may be up to 25 years), resolve disputes, and enforce our agreements. When information is no longer needed, we will delete or anonymize it in accordance with our data retention policies.
Roseth Mortgage reserves the right to update this Policy at any time. When we do, we will revise the "Last updated" date at the top of this Policy. Material changes will be communicated via email or in-app notification where appropriate. We encourage users to review this Policy periodically. Your continued use of our Sites following any changes constitutes acceptance of those changes.

Our Sites and Services are provided "as is" without warranties of any kind. We make no representations about the accuracy, reliability, or completeness of content on our Sites. To the fullest extent permitted by law, Roseth Mortgage and its officers, directors, employees, and affiliates shall not be liable for any direct, indirect, consequential, incidental, or special damages arising out of your use of our Sites.
You agree to indemnify and hold harmless Roseth Mortgage and its affiliates from any claims, losses, damages, costs, and expenses (including reasonable attorney's fees) arising out of your use of our Sites or any breach of these Terms.
We may terminate or suspend your access to our Sites at any time, without notice, for any reason, including violations of these Terms. Users may terminate their use at any time by contacting us.
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law principles. Any disputes will be resolved in the state or federal courts located in Minnesota.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
This Policy, including the Privacy and Terms of Use sections, constitutes the entire agreement between you and Roseth Mortgage regarding our Sites and Services, and supersedes all prior agreements.
